我们深知个人信息对您的重要性,秉承您对华晨宝马企业文化的认可而严谨对待您的个人信息。我们努力创造和维护与您的互信关系,为保护您的个人信息恪守以下原则:权责一致、目的明确、选择同意、最少必要、确保安全、主体参与、公开透明。同时,我们承诺按业界成熟的安全标准,采取相应的安全保护措施以充分保护您的个人信息。

    一、我们如何收集和使用您的个人信息

个人信息是指以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息,包括但不限于姓名、出生日期、身份证件号码、个人生物识别信息、地址、电话,但不包括匿名化处理后的信息。

敏感个人信息是指一旦泄露或者非法使用,容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的个人信息。一般而言,生物识别、宗教信仰、特定身份、医疗健康、金融账户、行踪轨迹等信息,以及不满十四周岁未成年人的个人信息等被视为敏感个人信息。在本政策中,有关敏感个人信息的条款将以加粗字体标注以提示您的特别注意。

我们仅会出于为完成华晨宝马招聘的业务功能目的而收集和使用您的个人信息。

除非另行明确,我们仅在实现本政策所述的目的所需的期间存储您的个人信息。如果信息被用于多种目的,一旦具体目的完成,您的信息将被删除或以不能直接或间接追溯到您的形式而存储。

 

(一) 个人信息收集途径

您自愿参与到我们的招聘流程中,我们会通过以下途径获取您的个人信息:

1. 直接招聘:我们通过纸质或在线表格的形式向您收集;

2. 内部推荐:华晨宝马的员工接受您的委托,通过在线表格的形式向我们主动提供;

3. 第三方推荐:您通过第三方招聘平台或猎头公司等向我们主动提供。

 

(二) 个人信息收集种类

通过上述途径,我们将可能获取您的以下个人信息:

1. 个人基本信息:微信Open ID、姓名、英文名、手机号、电子邮件、出生年月、性别、国籍、现所在地、家乡、户口所在地、最高学历、身份证号码、面部识别特征、声纹

2. 教育经历:开始时间、结束时间、学校、专业、学历;

3. 工作/实习经历:开始时间、结束时间、工作/实习单位、所在城市、部门、职位

4. 语言能力:语言、熟练程度、证书;

5. 附件:中文简历附件、英文简历附件、专业证书附件;

6. 个人工作信息:现有年总收入(税前)、本人年总收入愿望(税前)、工作年限、工作意愿;

7. 应急联系人:应急联系人姓名、电话、与本人关系;

8. 其他您主动提供的个人信息。

为方便您申请职位,我们允许导入您保存在第三方网站(包括前程无忧、猎聘网、智联招聘、BOSS直聘)上的简历,为向第三方网站发送相关请求,我们可能需要向您收集以下个人信息:

1. 第三方网站用户名;

2. 第三方网站密码。

如果您不提供上述信息,将无法调用您在第三方网站的档案快速完善您的简历,但不影响您使用我们提供的其他服务。

 

上述个人信息将在您提出删除请求或相关处理目的已实现后被删除,除非该等信息是根据法律法规的规定所必须保存的,或我们获得您的单独授权同意的。

 

 

 

(三) 处理个人信息的目的

上述个人信息是华晨宝马全面了解您个人背景,学历,技能等,并评估您是否适合您所申请的职位所需要的内容。我们处理您个人信息的目的包括:

1. 招聘和/或雇用决策;

2. 候选人评估;

3. 候选人身份确认;

4. 合规与风险管理。

 

(四)征得收集、使用个人信息授权同意的例外情形

根据相关法律法规及国家标准,在以下例外情形中,我们可能会依法收集并使用您的个人信息而无需征得您的授权同意:

1. 为订立、履行您作为一方当事人的合同所必需;

2. 为我们履行法定职责或法定义务所必需;

3. 为应对突发公共卫生事件,或者紧急情况下为保护您或他人的生命健康和财产安全所必需;

4. 为公共利益实施新闻报道、舆论监督等行为,在合理的范围内处理您的个人信息;

5. 依法在合理的范围内处理您自行公开或者其他已经合法公开的个人信息;

6. 法律、行政法规规定的其他情形。

 

请知悉,我们主要基于同意来处理您的个人信息,但如果法律法规规定的其他合法基础适用,我们将根据相应的合法基础处理您的个人信息。如您被华晨宝马正式聘用,则不再适用本政策,我们将会另有个人信息保护政策或类似文件供您签署。此外,根据适用法律,若我们对个人信息采取技术措施进行处理,使得该等信息无法重新识别特定个人且不能复原,则该等信息不再属于个人信息,相关使用无需另行向您告知并征得您的同意。

三、我们如何委托处理、共享、转让您的个人信息

(一)委托处理

为考察您作为候选人是否符合岗位要求,核验您提交信息的真实性,我们可能委托外部供应商处理您的个人信息。例如我们聘请服务提供商提供测评服务,以及服务提供商协助我们开展背景调查和体检服务。在委托处理的情形下,我们将在本政策的范围内,决定您的个人信息的处理目的和处理方式,而受托人将根据我们的指示处理您的个人信息。

在委托处理的情况下,对上述接受我们的委托、协助我们处理个人信息的公司、组织和个人,我们会根据您对我们的授权范围,与受托人约定委托处理的目的、期限、处理方式、个人信息的种类、保护措施及我们与受托人的权利义务等,并对其个人信息处理活动进行监督。我们将会确保受托人按照我们与其的约定处理您的个人信息,不会超出约定的处理目的、处理方式等处理您的个人信息。我们会与其签署严格的保密协定,要求其根据我们的要求、本个人信息保护政策以及其他任何相关的保密和安全措施来处理个人信息。

 

(二)共享

1. 与关联公司共享

我们不会与华晨宝马以外的任何公司、组织和个人分享您的个人信息,除非获得您的明确同意。与委托处理不同,在共享您个人信息的情况下,作为接收方的我们的关联公司将自主决定对您个人信息的处理目的和处理方式,因此在共享的情形下我们将会获得您的单独同意。

如您同意尝试华晨宝马及其关联公司的其他岗位机会,您的个人信息可能会与相关岗位机会所在的华晨宝马关联公司共享(请见本政策结尾处所列声明)。如您同意前述共享行为,接收您个人信息的华晨宝马关联公司将会作为本政策中的个人信息处理者,根据本政策的相关内容,对您的个人信息进行处理。如您不同意前述共享行为,您的个人信息将不会被主动分享给其他华晨宝马关联公司,用于尝试其他华晨宝马关联公司的岗位机会。

关联公司如要改变个人信息的处理目的,将再次征求您的授权同意。

2. 我们可能会根据法律法规规定,或按监管机构的强制性要求,对外共享您的个人信息。

3. 我们仅共享必要的个人信息,且受本个人信息保护政策中所声明目的的约束。

 

(三)转让

我们不会将您的个人信息转让给任何公司、组织和个人,但以下情形除外:

1.在获取明确同意的条件下转让。获得您的明确同意后,我们会向其他方转让您的个人信息。

2.在涉及合并、收购或破产清算时,如涉及到个人信息向公司的权利义务承继方转让,我们会单独向您告知有关情况,并要求新的持有您个人信息的公司、组织继续受此个人信息保护政策的约束,否则我们将要求该公司、组织重新向您征求授权同意。

 

(四)共享、转让个人信息时事先征得授权同意的例外情形

根据相关法律法规及国家标准,以下情形中,我们可能会共享、转让您的个人信息而无需事先征得您的授权同意:

1. 为订立、履行您作为一方当事人的合同所必需;

2. 为我们履行法定职责或法定义务所必需;

3. 为应对突发公共卫生事件,或者紧急情况下为保护您或他人的生命健康和财产安全所必需;

4. 为公共利益实施新闻报道、舆论监督等行为,在合理的范围内处理您的个人信息;

5. 依法在合理的范围内处理您自行公开或者其他已经合法公开的个人信息;

6. 法律、行政法规规定的其他情形。

 

四、我们如何保护您的个人信息

(一)我们已使用符合业界标准的安全防护措施保护您提供的个人信息, 防止数据遭到未经授权访问、公开披露、使用、修改、损坏或丢失。我们会采取一切合理可行的措施,保护您的个人信息。例如,我们会使用加密技术确保数据的保密性;我们会使用受信赖的保护机制防止数据遭到恶意攻击;我们会部署访问控制机制,确保只有授权人员才可访问个人信息;以及我们会定期举办安全和隐私保护培训课程,加强员工对于保护个人信息重要性的认识。

(二)我们会采取一切合理可行的措施,确保仅收集为实现本政策所述目的所必需的个人信息。我们只会在达成本政策所述目的所需的期限内保留您的个人信息,除非确有需要延长保留期并获得您的单独授权同意、或根据法律法规或有关数据保留期的特别监管要求。

(三)互联网环境并非百分之百安全,虽然我们致力于保护您的个人信息,但我们无法担保或保证其绝对安全。因此,您也应积极采取措施保证您的个人信息安全。

(四)在不幸发生个人信息安全事件后,我们将按照法律法规的要求,及时向您告知:安全事件的基本情况和可能的影响、我们已采取或将要采取的处置措施、您可自主防范和降低风险的建议、对您的补救措施等。我们将及时将事件相关情况以邮件、信函、电话、推送通知等方式告知您,难以逐一告知时,我们会采取合理、有效的方式发布公告。

同时,我们还将按照监管机构要求,主动上报个人信息安全事件的处置情况。

 

五、您的权利

按照中国相关的法律、法规、标准,以及其他国家、地区的通行做法,我们保障您对自己的个人信息行使以下权利:

 

(一) 访问、查阅、复制您的个人信息

您有权访问您的个人信息,但法律法规规定的例外情形除外。如果您想行使个人信息访问权,可以通过以下方式自行访问:

如果您无法通过上述链接访问您提交的个人信息,您可以发送邮件至:Career@bmw-brilliance.cn向我们查询您提交的个人信息相关情况。我们将在验证通过后不超过15个工作日内回复您的请求。

您也有权复制您的个人信息,或获取您的个人信息副本,您可以随时发送电子邮件至Career@bmw-brilliance.cn。

在技术可行的前提下,例如数据接口匹配,且符合国家网信部门规定的条件的,我们还可按您的要求,直接将您的个人信息副本传输给您指定的第三方。

 

(二)更正您的个人信息

当您发现我们处理的关于您的个人信息有错误或不完整时,您有权要求我们做出更正。您可以通过以下方式自行更正:

如果您无法通过上述方式更正您提交的个人信息,您可以随时发送电子邮件至Career@bmw-brilliance.cn。我们将在验证通过后不超过15个工作日回复您的请求。

 

(三)删除您的个人信息

在以下情形中,您可以向我们提出删除个人信息的请求:

1.如果我们处理个人信息的行为违反法律法规;

2.如果我们收集、使用您的个人信息,却未征得您的同意;

3.如果我们处理个人信息的行为违反了与您的约定;

4.如果处理您个人信息的目的已实现、无法实现或者为实现处理目的不再必要;

5. 您已经撤回您对我们处理您个人信息的授权同意。

若我们决定响应您的删除请求,我们还将同时通知从我们获得您的个人信息的实体,要求其及时删除,除非法律法规另有规定,或这些实体获得您的独立授权。

当您从我们的服务中删除信息后,因为适用的法律和安全技术限制,我们可能不会立即从备份系统中删除相应的信息,但我们将安全地存储您的个人信息并不再对其进行任何进一步的处理,直到备份可以清除或实现匿名化。为充分保护您的个人权益,我们可能在备份系统中保留必要信息,同时通过技术手段使该等信息保持不可被检索、访问的状态。

 

(四)改变您授权同意的范围或撤回您的同意

对于我们基于您的同意收集和使用您的个人信息,您可以通过发送邮件至Career@bmw-brilliance.cn改变或撤回您的同意。

当您撤回同意后,我们将不再处理您撤回同意范围内的个人信息。但您撤回同意的决定,不会影响此前基于您的同意而开展的个人信息处理。请注意,如果相关个人信息处理是为了履行法定职责或法定义务所必需的,那么您无权撤回该同意。

 

(五)响应您的上述请求

您可以根据上述列出的具体方式提出您对您个人信息的权利请求。为保障安全,您可能需要证明您的身份。我们可能会先要求您验证自己的身份,然后再处理您的请求。

我们将在15个工作日内做出答复。如您不满意,可以通过发送邮件至Career@bmw-brilliance.cn投诉。

对于您合理的请求,我们原则上不收取费用,但对多次重复、超出合理限度的请求,我们将视情形收取一定成本费用。对于无端重复、需要过多技术手段(例如,需要开发新系统或从根本上改变现行惯例)、给他人合法权益带来风险或者非常不切实际(例如,涉及备份磁带上存放的信息)的请求,我们可能会予以拒绝。

在以下情形中,我们将无法响应您的请求:

1.与我们履行法律法规规定的义务相关的;

2.与国家安全、国防安全直接相关的;

3.与公共安全、公共卫生、重大公共利益直接相关的;

4.与犯罪侦查、起诉、审判和执行判决等直接相关的;

5.我们有充分证据表明您存在主观恶意或滥用权利的;

6.出于维护您或他人的生命、财产等重大合法权益但又很难得到您同意的;

7.响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的;

8.涉及商业秘密的。

 

六、我们如何处理未成年人的个人信息

我们的招聘活动不以18周岁以下的未成年人为受众,我们不会主动向其收集个人信息, 如果我们发现收集的个人信息中包含未成年人的个人信息,则会设法尽快删除相关未成年人的个人信息

 

七、您的个人信息如何在全球范围转移

我们在中华人民共和国境内收集和产生的个人信息,将存储在中华人民共和国境内。因此,您的个人信息不会被转移到中国境外管辖区,或者受到来自中国境外管辖区的访问。

 

八、本政策如何更新

我们的个人信息保护政策可能变更。未经您明确同意,我们不会削减您按照本个人信息保护政策所应享有的权利。我们会在本页面上发布对本政策所做的任何变更。我们会将本政策的旧版本存档,供您查阅。

This Personal Information Protection Policy solely applies to various recruitment services provided by BMW Brilliance Automotive Ltd., LingYue Digital Information Technology Co., Ltd. (“BBA" or "LingYue" or "We") through various recruitment services provided by BBA’s official recruitment account and recruitment website.

The Company with relevant recruiting positions (referred to as "BBA" or "We") will determine the purpose for and method of processing your personal information and protect your personal information in accordance with the provisions of this Personal Information Protection Policy.

We are committed to creating and maintaining your trust in us and observe the following principles when protecting your personal information: consistency between rights and liabilities, clear purposes, solicitation of consent, minimum necessity, guarantee of security, involvement of personal information subjects, and openness and transparency. Meanwhile, we are committed to setting up necessary safeguards pursuant to well-developed security standards to protect your personal information.

By affixing your signature hereto or clicking/ticking on “read and agree” or other similar options, and submitting to us your personal information, you have accepted this Personal Information Protection Policy. We will use and protect your personal information according to the relevant laws and regulations and this Personal Information Protection Policy. 1. How we collect and use your personal information

Personal information means any information recorded in electronic or other forms that relates to an identified or identifiable natural person, including but not limited to name, date of birth, identification number, personal biometric information, address, and telephone number, but excluding anonymised information.

Sensitive personal information means the personal information that is likely to infringe on the personal dignity of, or endanger the personal or property safety of, a natural person, once it is leaked, unlawfully used. In general, biometric information, religious beliefs, particular identities, medical health, financial accounts, personal whereabouts, and other information, as well as personal information of minors under the age of fourteen are regarded as sensitive personal information. In this Personal Information Protection Policy, the terms and articles concerning sensitive personal information will be marked in bold for your special attention. 

We will collect and process your personal information solely for the purposes specified as below.

Unless otherwise indicated in this Personal Information Protection Policy, we store your personal information only if necessary to fulfill the purposes stated in this policy. If your personal information is processed for multiple purposes, your information will be deleted or stored in a form that cannot directly be traced back to you as soon as the last specified purpose has been fulfilled.

 

A. Personal information collection methods

You participate in our recruiting process on a voluntary basis, and we collect your personal information through the following methods:

1. Direct recruitment: you fill in paper forms or online forms to provide your personal information to us;

2. Internal referrals: BBA employees authorized by you to fill in paper forms or online forms to provide your personal information to us;

3. Third party recommendation: you proactively provide your personal information to us through third-party recruitment platforms, headhunters or the like.

 

B. Types of personal information collected

Through the above methods, we may collect the following personal information of you:

1. Basic personal information: Open ID of WeChat Account, Name, English Name, Mobile No., Email, Birth Date, Gender, Nationality, Current Place, Hometown, Place of Hukou Registered, Highest Academic Qualification, ID cardFacial recognition featuresVoiceprint;

2. Education experience: University/School name, Major, Degree, Start Date, End Date;

3. Previous Employment/Internship Experience: Company, City, Department, Position Title, Start Date, End Date;

4. Language Skills: Language; Language Proficiency level; Language Certifications;

5. Attachment: Resume (Chinese version); Resume (English version); Professional Certifications;

6. Personal Work Information: Yearly Actual Income (Pre-tax), Yearly Income Expected (Pre-tax), Work Year, Motivation;

7. Emergency contact: Emergency Name, Emergency Mobile No., Relationship;

8. Other personal information you provide proactively.

 

For your convenience of your position application, it is allowed to import your resume saved on third-party websites (including 51 Job, Liepin, Zhilian Zhaopin, BOSS Zhipin). To send relevant requests to third-party websites, we may need to collect the following personal information from you:

1. Username of third-party website;

2. Passcode of third-party website.

If you choose not to provide the above information, we will not be able to access your resume on third-party websites to polish your resume quickly. Notwithstanding the above, lack of access will not affect your use of other services that we provide.

 

The above personal information will be deleted after your request for deletion, or the relevant processing purpose has been achieved, unless it is required to be retained under laws and regulations or your further authorization and consent is obtained.

 

 

C. Personal information processing purposes

The above personal information is necessary for BBA to develop a comprehensive understanding of your experience, education background and skills, etc., and to assess your suitability for the position for which you are applying. We process your personal information for purposes including:

1. Recruiting and/or making employment decisions;

2. Evaluating candidates’ qualifications;

3. Confirming the identity of candidates;

4. Compliance and risk management.

 

D. Exceptions to acquire authorization and consent for collection and use of personal information

In accordance with relevant laws, regulations, and national standards, we may collect and use your personal information without your consent in the following scenarios:

1. where it is required to enter and perform a contract to which you are a party;

2. where it is required for us to perform statutory duties or statutory obligations;

3. where it is required to respond to public health emergencies or protect the life, health, and property safety of you and others;

4. processing of your personal information to a reasonable extent to implement news reporting, public opinion supervision or other acts for the public interest;

5. lawfully processing of your personal information disclosed by you or otherwise lawfully disclosed to a reasonable extent;

6. other scenarios stipulated in laws and administrative regulations.

 

Please note that we process your personal information based on your consent, but if other legal basis specified by laws and regulations are applicable, we will process your personal information based on the corresponding legal basis. If you are formally employed by BBA, this policy will no longer apply to you, and we will have another personal information protection policy or similar documents for you to sign. In addition, in accordance with applicable laws, if we take technical measures to process personal information, consequently making it impossible to re-identify particular individuals and restore the processed information to raw personal information, then the processed information is no longer personal information and we do not need to inform you or obtain your consent for the use of the processed information.

3. How We Entrust, Share, Transfer Your Personal Information

A. Entrusted processing

To assess whether you, as a candidate, meet the job requirements and verify the authenticity of the information you submitted, we may entrust external suppliers to process your personal information. For example, we may engage service providers to assist us in background investigation and criminal record inquiry. In the case of entrusted processing, we will, to the extent of this Personal Information Protection Policy, determine the method of and purpose for processing your personal information, and the entrusted party will process your personal information as instructed by us.

In the case of entrusted processing, we will, based on your scope of authorization, enter into agreements with companies, organizations and individuals entrusted by us to process personal information, which specify the purpose, term and method of processing, types of personal information, protection measures and rights and obligations of BBA and the entrusted, and supervise their processing of personal information. We will ensure that the entrusted companies, organizations, and individuals process your personal information in accordance with the agreements and will not process your personal information beyond the agreed purpose for and method of processing. We will enter into strict non-disclosure agreements with all entrusted companies, organizations, and individuals, which require them to process personal information according to our instructions, this Personal Information Protection Policy and any other related measures for confidentiality and security.

 

B. Sharing

1. Sharing information with our affiliates

Aside from entrusted processing, we may share your personal information with our affiliates from time to time. Different from entrusted processing, in the case of sharing your personal information, our affiliates as the data recipient will independently determine the purpose for and method of processing your personal information. Therefore, in the case of personal information sharing, we will obtain your separate consent.

If you agree to apply for other positions in BBA and its affiliates, your personal information may be shared with the BBA affiliate to which the relevant position is offered (see statement at the end of this policy). If you agree to the above sharing, the BBA affiliate receiving your personal information will act as the personal information processor in this policy and process your personal information in accordance with the relevant content of this policy. If you do not consent to the above sharing, your personal information will not be proactively shared with other BBA affiliates for purposes of trying for positions in other BBA affiliates.

If an affiliate changes the purpose for processing your personal information, your further authorization and consent will be obtained.

2. We may share your personal information with external parties as required by laws or regulations or upon compulsory requirements of competent government authorities.

3. We will share necessary personal information only for the purposes specified in this Personal Information Protection Policy.

 

C. Transfer

We will not transfer your personal information to any other company, organization or individual, except under the following circumstances.

1. Transferring information with explicit consent: we will transfer your personal information to other parties after obtaining your explicit consent.

2. If your personal information must be transferred to our successor in the event of a merger, acquisition, or bankruptcy liquidation, we will inform you separately and require the company or organization that will successively possess your personal information to comply with this Personal Information Protection Policy. Otherwise, we will require the successor to re-obtain your authorization and consent.

 

D. Exceptions to acquire authorization and consent for sharing and transfer of personal information

In accordance with applicable laws, regulations, and national standards, we may share or transfer your personal information without your prior authorization and consent if: 

1. where it is required to enter and perform a contract to which you are a party;

2. where it is required for us to perform statutory duties or statutory obligations;

4. How We Protect Your Personal Information

1. We store your information based on the state of the art and we take the following safeguards to protect your personal information from misuse or any other unauthorized processing, disclosing, using, rectifying, destroying, or losing. We will take all reasonable and feasible measures to protect your personal information. For example, we will use encryption technology to ensure the confidentiality of data; we will use a trustworthy protection mechanism to prevent data from being attacked maliciously; we will deploy an access control mechanism to ensure that only authorized personnel can access personal information; and we will regularly deliver security and privacy protection training courses to enhance employees' awareness of the importance of protecting personal information.

2. We will take all reasonable and feasible measures to ensure that we only collect such personal information as required to realize the purposes specified in this Personal Information Protection Policy. We will only retain your personal information for a limited period necessary for realizing the purposes specified in this Personal Information Protection Policy unless it is necessary to extend the retention period, or it is protected under the law.

3. The Internet is not a safe environment. Although we are committed to protecting your personal information, we cannot guarantee or warrant that it is secure. Therefore, you shall also proactively take measures to ensure the security of your personal information.

4. In the case of any personal information security incident, we will, pursuant to requirements set forth in laws and regulations, inform you promptly of the particulars, including basic information about the security incident and the likely impact, what measures we have taken or will take to respond to such incident, suggestions on what measures you may take yourself to guard against and lower risks, remedial actions we offer to you, etc. We will notify you of the progress of the incident by email, correspondence, phone or by sending notifications, and we will release announcements for this purpose in a reasonable and effective manner even when it is difficult to notify personal information subjects one by one.

Meanwhile, we will proactively report how the personal information security incident is being handled pursuant to the requirement of the regulator.

 

5. Your Rights

According to applicable Chinese laws, regulations and standards, and common practices in other countries and regions, we protect the following rights relating to your personal information:

 

A. Access, view and copy your personal information

You have the right to copy your personal information or obtain a copy of your information. You may contact us by emailing [Career@bmw-brilliance.cn].

If technically feasible, for example APIs are integrated successfully, and requirements provided by the state cyberspace administration are met, we can directly transfer a copy of your personal information to the third party designated by you.

 

B. Correct your personal information

If you find that your personal information, we process is inaccurate or incomplete, you have the right to request us to correct your information. You may make correction by visiting [Menu ->Personal Center>Personal Center>Resume Management>Full Resume], to polish your profile.

If you are unable to correct the personal information you submitted through the above link, you may contact us by emailing [Career@bmw-brilliance.cn]. Upon authentication of your identity, we will respond to your request within 15 working days.

 

C. Delete your personal information

You may request the deletion of your personal information under any of the following circumstances:

1. When our processing of personal information violates laws or regulations;

2. When we collect or use your personal information without your consent;

3. When our processing of personal information violates our agreement with you;

4. When you have achieved, or find it impossible or unnecessary to achieve, the purpose of processing your information; 

5. When you withdraw your consent to our processing of your personal information.

If we agree with your request to delete information, we will also notify entities that collect your personal information from us and require them to delete the information concerned in a timely manner, unless otherwise stipulated by laws and regulations or such entity has obtained your separate authorization.

Once your information has been removed from our services, due to the restrictions under the applicable laws and regulations, we may not immediately delete the corresponding information from the backup system, but we will store the information safely without further processing until the backup could be eliminated or anonymized. To fully protect your personal rights and interests, we may retain the necessary information in the backup system whilst keep such information unsearchable or inaccessible through technical means.

 

D. Change the scope of your authorization or withdraw your consent

You may change the scope of your authorization or withdraw your consent by emailing [Career@bmw-brilliance.cn] in terms of our collection and use of your personal information based on your consent.

After you have withdrawn your consent, we will no longer process the personal information in respect of which your consent is withdrawn. It is worth mentioning that your withdrawal of your consent does not affect the previous processing of personal information based on your authorization. Please note that you are not entitled to withdraw the consent to the data processing which is necessary for the performance of legal duties or obligations.

 

E. Respond to your requests

You may make requests in respect of your personal information through the above said methods. For the sake of security, you may be required to authenticate your identity. We may request authentication of your identity before responding to your requests.

In principle, we will not charge fees for your reasonable requests. However, if your requests are lodged repeatedly or beyond a reasonable extent, we will charge fees of a proper amount depending on the cost. We may refuse your requests if they are repeated without reason, need to be replied to through excessive technical methods (for example, a new system needs to be developed or the existing common practices need to be fundamentally reformed), pose risks to others’ legal rights or interests, or are fairly unrealistic (for example, it involves information stored on backup tapes).

We will not respond to your requests under any of the following circumstances.

1. Where requests are in relation to our performance of the obligations specified in laws and regulations;

2. Where requests are in direct relation to the national security or national defence security;

3. Where requests are in direct relation to the public security, public sanitation, or major public benefits;

4. Where requests are in direct relation to investigations into crimes, prosecutions, court trials, execution of rulings, etc.;

5. Where we have sufficient evidence that you are intentionally malicious or abusing his/her rights;

6. Where personal information collecting and processing are for the sake of safeguarding significant legal rights and interests, such as the life and property of you or other individuals, but it is difficult to obtain your or their consent;

7. Where responses to your requests will give rise to serious damage to the legal rights and interests of you or any other individual or organization; or

8. Where requests involve trade secrets.

 

6. How We Deal with Minors’ Personal Information

Our recruitment does not target minors under the age of 18, we will not proactively collect personal information from them. If we find that the collected personal information contains the personal information of minors, we will do our best to delete relevant personal information of such minors as soon as possible.

 

7. How Your Personal Information Will Be Transferred Globally

The personal information we collect and generate within the territory of the People’s Republic of China (PRC) will be stored within the territory of the PRC.
